Don’t Talk To The Claims Adjuster

My name is Brock Showalter, and own Showalter Law Group, PA. I and my affiliated attorneys have recovered our clients millions of dollars. One of the biggest concerns that I have is that insurance claims adjustors prevent millions of people from getting the help that they need because they convince people that they do not need help. It costs absolutely nothing to see a personal injury attorney, and in almost all cases you will get four to five times more money with a personal injury attorney than you would by trying to handle the claim yourself.

In this series of articles, we are going to give you the insider secrets about auto accidents. We are going to cover auto accidents from the time a person is in one to the settlement for injuries. We will explain what to do if you are in an auto accident, why you should not talk to the insurance claims adjustors, and how to get the most money for your injuries.

The last topic that we discussed was what to do immediately after an auto accident. In this article, we will explore why you should never talk to an insurance claims adjustor!

Article 2: Don’t Talk To The Claims Adjuster

After you have been involved in an auto accident; you are often injured and in a state of panic. Sometimes you may go immediately the hospital. The natural reaction is to panic; and the insurance claims adjustors prey on this fact!

Now remember that Jake and Tim have just been in an accident, and the police have come to the scene and made their report. Jake has some pain and decides he wants to be very cautious. The police have taken the insurance information from both parties, and they ask if anyone wants to go the ER to be checked out. Jake of course does take the ambulance there as he is not sure how severe his injuries really are.

At this point, although we know that Tim was at fault in the accident, Jake of course does not know that yet. He gets to the hospital, and of course the hospital requires his insurance information. He is there for over 5 hours between waiting and getting CAT Scans, etc. He starts to get nervous as he knows he has cut rate insurance that might only cover a fraction of his hospital costs. Then a guy comes into the ER and tells him that he is with the insurance company for Tim’s vehicle. He tells Jake that he will give him $5000.00 immediately if he will just sign this piece of paper! Jake of course is panicked about getting hit with a big bill and decides to accept the offer.

This is why insurance claims adjustors are the real ambulance chasers! Now I am going to explain to you exactly why that statement is 100% true! When that claims adjustor comes to you in the hospital and offers you money, he is not telling you that once you accept it, you sign a claims waiver that never allows you to collect another penny on that claim ever again!

In order to accept any money, you must sign a little piece of paper known as a waiver. The adjustor might come to you and offer you something like $5000.00 immediately to settle your claim as just happened in Jake’s case. In a panic, you think that sounds like a great deal and accept and sign. Then a month later, you are told by your doctor that you need surgery that will cost $25,000.00. Then you call the claims adjustor and say you need more money. He of course then laughs at you and reminds you that little piece of paper you signed means that you are screwed!

This is exactly what happened to Jake in our story. Tim’s insurance company immediately knows that they are at fault and will likely have to pay for all of Jake’s medical care and some additional damages. They know that if they rush to the hospital to throw a few crumbs at Jake, then they don’t have to pay for any major medical care later in the future.

What Jake should have done in this instance is tell the claims adjustor that he already has an attorney, and only the attorney can speak to him. That is the only protection that Jake has against getting screwed by the claims adjustor.

Insurance companies spend millions of dollars in advertising to convince people that they are the nice guys when in reality they are out to screw you out of money and pay out as little as possible! They don’t care what happens to you! They don’t care if you are ruined financially! They use the things you don’t know against you. That is why you always need an attorney to do your injury claim.
